Update to Minnesota Human Rights Act Included in 2023 Legislative Changes

While we tried to get you all of the 2023 changes affecting employers, there’s one more your company needs to include in its policies.

Effective right now, the phrase “Gender identity” will be added to the Minnesota Human Rights Act.  The Act adds the following definition:

“Gender identity” means a person’s inherent sense of being a man, woman, both, or neither. A person’s gender identity may or may not correspond to their assigned sex at birth or to their primary or secondary sex characteristics. A person’s gender identity is not necessarily visible to others.

Gender identity was previously considered to be part of the class, “sexual orientation,” it is now appropriately separated.  Anti-discrimination policies should be updated so employees are aware of the change.
